The petitioner's father died on 9.8.1999 while he was working as a teacher. The petitioner was given compassionate appointment on a Class IV post on 9.8.1999. The petitioner has been working since then on Class IV post. In the meantime, the petitioner has acquired qualification for appointment as Assistant Teacher.
This petition has been filed for a direction to the authorities to appoint him as Assistant Teacher on compassionate grounds.
Sri Diwanshu Tiwari, holding brief of Sri R.K. Shukla, learned counsel for the petitioner was asked to show the Rules or Regulations under which he can claim compassionate appointment on the post of Assistant Teacher as he has acquired eligibility in the meantime after his initial appointment on the Class IV post. Learned counsel for the petitioner has been unable to point out any Rule or Regulation in this regard.
A compassionate appointment is given to provide immediate financial assistance to the family whose bread earner has died during harness. This is provided for immediate financial help. After ten years, the petitioner does not get any right to be considered for compassionate appointment on a higher post after he has acquired qualification for such a post though he was given compassionate appointment on Class IV post.
This petition is totally misconceived and without any merits. It is, accordingly, dismissed.
