Heard the learned counsel for the petitioner and the learned standing counsel who appears for the State respondents.
The petitioner is aggrieved by the non payment of subsistence allowance during that period he remained under suspension.
It has been submitted by the learned counsel for the petitioner that the petitioner was falsely implicated in a criminal case under Sections 363, 366 and 376 IPC read with section 3/4 of the POCSO ACT. He has now been acquitted and has been reinstated in pursuance of such acquittal on 8.9.2017, but his dues have not been paid to him till date.
He made a representation to the respondent no. 3 which was forwarded for action to the respondent no. 2, but the respondent no. 2 has informed him by his letter dated 19.5.2018 that verification of record is still continuing.
I have gone through the letter dated 19.5.2018 that specifically asked the petitioner to submit his certificate regarding his not being gainfully employed during the period of suspension. The petitioner has submitted such certificate only on 10.10.2018. The writ petition has been filed on 26.10.2018.
Accordingly, this writ petition is disposed of without entering into the merits of the controversy with a direction to the respondent no. 2 to look into the grievance of the petitioner and pass appropriate orders within a period of two months from the date a certified copy of this order is produced before him.
