Heard Shri Vikas Budhwar, learned counsel for the petitioner, learned standing counsel for the respondent no. 1 and Shri Vikram Bahadur Yadav for the respondent no. 2 and Shri P.D. Tripathi, learned counsel for the respondent no. 3.
The petitioner in the writ petition is seeking appointment on compassionate ground on the ground that his brother late Govind Kumar who was working as Assistant Teacher died while still in service on 8.12.2015 while performing duties in the Panchayat elections. In pararaph 5 of the writ petition family chart has been given which shows that the father of the petitioner is still alive.
In this circumstances the petitioner cannot be said to be a dependent upon his brother when his father is still alive. Therefore, no direction can be given to the respondents to consider the claim of the petitioner for appointment on compassionate ground as no such ground lies in his favour when he is not a dependent on his brother rather he is dependent upon his father.
The writ petition lacks merit and is accordingly dismissed.
