Heard learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed with a prayer to quash the interim maintenance order dated 18.11.2017 passed by Judge Family Court, /F.T.C. II, Jaunpur, under Section 125 Cr.P.C., in Case No. 313 of 2014 (Dipika Vs. Arvind Kumar).
The present application has been filed against the order dated 18.11.2017, by which the interim maintenance @ of Rs. 2,500/- towards opposite party no.2 and Rs. 1,500/- to her daughter have been awarded. The final orders on the application under Section 125 Cr.P.C. are still awaited. It has also been submitted by learned counsel for the applicant that there is some room for settlement in the matter.
Having considered the above, I do not find any good ground to interfere in the application, at this stage inasmuch as final orders on the application under Section 125 Cr.P.C. are still awaited and the interim monthly maintenance allowance provided for his wholly nominal and minimal as is necessary to preserve human life and dignity.
No interference is warranted at this stage. The application is dismissed.
