Grievance of the petitioner with regard to non payment of his salary from the month of May 2018 on the basis of 7th Pay Scale and arrears, needs to be examined at first instance by the respondent no.3 - District Basic Education Officer.
Learned standing counsel representing the respondent nos. 1 and 2 and Sri Nisheeth Yadav, learned counsel for the respondent nos. 3 and 4 submit that grievance of the petitioner shall be considered by the respondent no.3 and an appropriate decision, in accordance with law, shall be taken within a time bound period.
In view of the aforesaid, this writ petition is disposed of giving liberty to the petitioner to make a representation before the respondent no.3 within three weeks' alongwith a certified copy of this order, raising his grievances. In the event, such a representation is made within the stipulated period the respondent no.3 shall decide the representation strictly in accordance with law, expeditiously, preferably within next six weeks, after affording reasonable opportunity of hearing to the petitioner and the respondent no.5.
In the event, any amount is found legally due and payable to the petitioner, it shall be ensured by the respondent no.3 that it is paid to the petitioner within next four weeks.
It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner.
