Heard learned counsel for the parties.
By means of this contempt application filed under section 12 of the Contempt of Courts Act, 1971 non-compliance of the order of writ Court dated 06.07.2020 passed in Writ- A No.- 5007 of 2020 is complained of.
Sri Mata Prasad, learned Standing Counsel submits that he has obtained instruction in the matter in compliance of the last order of this Court dated 02.09.2021 and as per the instruction, the claim of the applicant regarding transfer from Amroha to Banda has been considered by the competent authority and rejected by passing an order on 21.09.2021.
Copy of the instruction is supplied to learned counsel for the applicant in the Court itself and the same is also placed on record.
In the considered opinion of this Court, since the writ Court had simply issued a direction for consideration of application of the applicant for transfer from one place to another and the said application has come to be decided by the competent authority by passing an order in writing, the order of writ Court has stood complied with in its letter and spirit.
In view of the above, the there remains nothing for the applicant to continue this contempt application.
Contempt application is accordingly consigned to record. Notices issued, if any, stand discharged.
