Petitioner's claim for promotion has been declined on the ground that an order of punishment has been passed against him and that his services for the required period were not satisfactory. This order is assailed in the present writ petition.
The order impugned clearly records that though petitioner's name was within the zone of consideration for promotion to the post of Inspector from the post of Platoon Commander, but on account of awarding of minor punishment during the last five years and three minor punishments during the period of last ten years, he has been found unfit.
Though various submissions are advanced but no illegality is shown in the order impugned. The criteria for promotion clearly eliminates claim of those persons who have been awarded minor punishment in the last five years or more than three punishment in the last ten years. Action of the respondents in non-suiting the petitioner is based upon the criteria specifically laid down. No error is, therefore, found in the order impugned.
Writ Petition is, accordingly, dismissed.
