Heard learned counsel for the petitioner; Shri B.B. Pandey, learned Additional Chief Standing Counsel for the State respondents and Shri R.C. Upadhyay, learned counsel appearing for the Gaon Sabha.
The instant writ petition has been filed against the order dated 2.6.2018 passed by the fourth respondent, District Supply Officer, Ballia. Even though various grounds have been raised by the petitioner assailing the order, learned Standing Counsel stated that the impugned order is an appealable one.
Under such circumstances, I direct that if the petitioner files an appeal within a period of three weeks from today, the appeal shall be decided within a period of two months thereafter. The petitioner may also file an application for staying the impugned order. On the stay application, orders shall be passed within a week from the date of filing of the same.
The writ petition is accordingly disposed of.
If any third party right is created, it shall be subject to the decision of the appeal.
