The petitioner's Writ Petition No.5296 (SS) of 2019 was finally disposed of eh Writ Court vide judgement and order dated 25.2.2019 in following terms :-
"By means of this petition, the petitioner has prayed that the opposite parties be directed to consider the candidature of the petitioner for absorption as Kurk-Amin in accordance with Rule 6(1) of the U.P. Cooperative Collection Funds and Amin and other Employees Service Rules 2002, in the light of judgment of Hon'ble Supreme Court in the case of State of U.P. Vs. Chandra Prakash Pandey reported in AIR 2001 SC 1298.
The petitioner has also preferred a representation dated 26.12.2018, but no decision has been taken in the aforesaid representation. He has further submitted that the ends of justice would suffice if necessary direction is issued to the authority concerned for disposal of the said representation.
Therefore, in view of the above, without entering into merits of the issue, the Principal Secretary, Cooperative Societies, U.P., Lucknow, is directed to decide the representation of the petitioner dated 16.12.2018 by speaking and reasoned order, strictly in accordance with law, expeditiously within a period of three months from the production of certified copy of order of this court.
In view of the aforesaid terms, the writ petition is disposed of finally. "
In pursuance to the notice issued in this contempt petition, a compliance affidavit of Mr. M.V.S. Rami Reddy, Principal Secretary, Cooperative Department, Civil Secretariat, Lucknow has been filed. Along with the aforesaid affidavit, a copy of the decision dated 16.8.2019 taekn on the representation of the petitioner has been placed on record as Annexure No.A-1 to the affidavit, in which it has been said that the petitioner cannot be adjusted as regular employee on the post of Kurk Amin.
In view of the aforesaid decision dated 16.8.2019 taken on the representation of the petitioner, nothing survives in the present contempt petition, which is hereby disposed of as having become infructuous.
However, if the petitioner is aggrieved by the aforesaid decision dated 16.8.2019 taken on his representation, he may approach the competent Court/forum, if he is so advised and law permits.
Contempt notice stands discharged.
