Heard Sri Hanuman Prasad Mishra, learned counsel for the petitioner.
The present petition seeks a direction to the respondent no.1/Additional Civil Judge (Senior Division), Court No. 16, Allahabad to decide 6-C application filed in Original Suit No. 622 of 2019 (Arvind Kumar Mishra Vs. Chandra Bhushan Mishra and others), which is said to be pending.
Learned counsel for the petitioner has referred to the order sheet of the case, a copy whereof has been filed as annexure 3 to the writ petition, to submit that the notices have been issued on the 6-C application and the defendants have put in their appearance and also filed their objections. It is stated that although various dates are being fixed but for some reason or the other, the 6-C application has not been disposed as yet. It is also submitted that the delay in disposal of the said application is causing undue hardship to the petitioner.
In view of the aforementioned facts and circumstances, the present petition is disposed of with an observation that in case the petitioner appears before the court concerned and does not seek any unnecessary adjournment it is expected that the court below would make an endeavour to decide the aforesaid application expeditiously in accordance with law provided there is no other legal impediment.
