Heard learned counsel for the petitioner and Sri Vikram Bahadur Yadav learned Standing Counsel for the State respondents.
The petitioner had applied in the recruitment exercise initiated by the respondents in 2015. He had claimed the benefits of reservation on account of belonging to Other Backward Classes. The certificate however which was presented in support of this claim clearly shows that it was one relating to applicants who were applying for appointment to posts under the Government of India. The said certificate could not possibly be countenanced by the respondents bearing in mind the principles enunciated by the Full Bench of the Court in Gaurav Sharma Vs. State of U.P. And Others [2017(5) ADJ 494]. The petitioner subsequently furnished another OBC certificate issued by the State Government. This certificate however was issued after the last date fixed under the advertisement/notification.
In view of the above, the prayers as made cannot be granted. The writ petition is dismissed.
