Supplementary affidavit filed today is taken on record. Heard learned counsel for the applicant and learned A.G.A.
The informant is the applicant; deceased is the younger brother of the applicant; as per the prosecution case, fire arm injury was caused upon the deceased; postmortem examination report shows four entry wound and one exit wound; assault weapon was discovered on the pointing out of the applicant.
Learned A.G.A. has vehemently opposed the prayer for bail and submits that the postmortem examination report supports the prosecution case and it is not be in the public interest to enlarge the applicant on bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant, Arvind Gautam, involved in Case Crime No. 314 of 2017, under sections 452, 302, 201 I.P.C. with section 3/25 and 27/30 Arms Act, Police Station Bardah, District Azamgarh.
Accordingly, the bail application is rejected.
The trial court is directed to expedite the trial of the aforesaid case and conclude the same expeditiously on day to day basis within six months from the date of production of a certified copy of this order, if, there is no legal impediment.
The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
