This bail application has been moved by the applicant Arvind Chauhan @ Chhedi Chauhan who is involved in Case Crime No. 0111 of 2018, under Sections 302 and 201 I.P.C., Police Station-Birno, District-Ghazipur.
As per prosecution version, Hareshwar Prasad Rai father of informant Vineet Rai was last seen on 21.08.2018. After that on 22.08.2018 at about 10 A.M., his dead-body was recovered.
Learned counsel for the applicant contended that applicant is not named in F.I.R. There is no evidence on record to show the involvement of applicant in murder of Hareshwar Prasad Rai. He further contended that co-accused Manoj Chauhan has already been enlarged on bail vide order dated 14.12.2018 passed by this Court in criminal misc. bail application no. 44530 of 2018. Case of the applicant is similar to that of co-accused Manoj Chauhan. Applicant has no criminal antecedents.
Learned A.G.A and learned counsel for informant opposed the prayer for bail. However, they admitted this fact that role of applicant is similar to that of co-accused Manoj Chauhan.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant-Arvind Chauhan @ Chhedi Chauhan, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
