Heard learned counsel for the petitioner, learned Standing Counsel appearing for the State- respondents and Sri Pranjal Mehrotra, learned counsel appearing for respondent no.2.
Against the order of provisional assessment in the case of electricity theft, the petitioner had approached this Court by filing a writ petition being Writ C No. 27357 of 2018 which was disposed of by order dated 21.8.2018 requiring the petitioner to appear before the Executive Engineer and file objection.
Sri Pranjal Mehrotra, learned counsel appearing for respondent no.2 submits that on several occasions the petitioner was given opportunity to appear before the authority and file his objection but after repeated request, the petitioner did not appear before the authority concerned. The submission of Sri Pranjal Mehrotra, learned counsel is upon written instruction received by him.
That being the case, no relief can be granted to the petitioner in this writ petition. However, if the petitioner has filed his objection, the same be considered and decided by the authority concerned in accordance with law.
With the aforesaid observation/direction, the writ petition stands finally disposed of.
