JUDGMENT / ORDER

Petitioner is the second accused in Crime No.36 of 2014 of the Thiruvalla Excise Range Office for the offences punishable under Secs.55(a) and (i) of the Kerala Abkari Act for alleged possession of 5.875 liters of IMFL for sale, apprehends arrest and has filed this application.
2. Learned Public Prosecutor has opposed the application.
It is submitted that contraband was seized from the house where the petitioner also is residing. It is also submitted that up to 2011, 5 cases were registered against the petitioner for similar offences and the Chengannur police have registered Crime No.59 of 2012 against the petitioner for alleged possession of 35 liters of spirit.
3. Learned counsel submits that the allegations against the petitioner are not true. The first accused is the mother of the petitioner. Petitioner is staying away from the house in question.
4. Having regard to the nature of the allegations made against the petitioner and the investigation required to be done, request for pre-arrest bail cannot be allowed. It is directed that in case the petitioner is arrested, he shall be produced before the B.A.No.3486 of 2014 2 jurisdictional magistrate as early as possible.
The application is disposed of with the above direction.
