Petitioners … Respondent These Writ Petitions are filed under Articles 226 and 227 of the Constitution Of India praying to direct the respondent to issue NOC with respect to Site No.118, Site No.40, Site No.51 and Site No.121 situated in Sy.Nos.39/3, 39/4(p), 39/7(p), 40/3, 40/4, 40/5, 40/7 and 41, Balaji Layout, Anjanapura Village, Uttarhalli Hobli, Bengaluru South Taluk and etc.
These Writ Petitions are coming on for Preliminary Hearing, this day, the Court made the following:
O R D E R The petitioners have sought for a direction to the respondents to issue Khatha with respect to site Nos.118, 40, 51 & 121 situated in Sy.Nos.39/3, 39/4(P), 39/7(P), 40/3, 40/4, 40/5, 40/7 and 41, Balaji Layout, Anjanapura Village, Uttarahalli Hobli, Bangalore South Taluk considering the representations made by the petitioners at Annexures- Q, R, S and T to the writ petitions.
2. The petitioners are claiming to be the absolute owners of the properties aforementioned and have sought for change of khata with respect to their sites vide representations but in vain. Hence, these writ petitions.
3. In the facts and circumstances of the case, there is no inhibition for respondent – BDA to consider the representations of the petitioners at Annexures – Q, R, S and T to the writ petitions in accordance with law. Hence, respondent - BDA is directed to consider the representations of the petitioners at Annexures – Q, R, S and T and take a decision in the accordance with law in an expedite manner, in any event, not later than eight weeks from the date of receipt of the certified copy of the order.
4. It is needless to observe that any decision taken against the claim made by the petitioners shall be communicated to the petitioners.
Writ petitions stand disposed of in terms of the above.
