Arunbhai vs State

High Court Of Gujarat|24 April, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE A.L.DAVE) Heard learned Advocate Mr.Suthar for the petitioner and Mr.R C Kodekar, learned Additional Public Prosecutor for respondent No.1.
2. Learned Additional Public Prosecutor has indicated that the Investigating Agency has taken all possible steps to locate the corpus, but in vain. The photographs have been sent to many Police Stations and are also sent for being published in media through proper channel. The efforts have gone in vain, however they are still continued.
3. The petitioner also does not have any grievance on the nature of efforts made by the Investigating Agency and, as such, no fault can be found with it for not being able to trace the corpus.
4. We are satisfied that the Police Authorities have taken adequate steps to locate the corpus, though they have not been successful in locating. Keeping this matter pending, in our view, is not likely to yield any fruitful result. We are, therefore, disposed of this petition with a direction to the Police Agency to continue the search of the corpus.
5. The petition is disposed of with above directions. Notice discharged.
6. The amount of Rs.10,000/- (Rupees Ten Thousand Only) deposited with the Registry shall be refunded to the petitioner on proper identification.
