This writ petition has been filed challenging the order dated 25.10.2017 passed by the District Basic Education Officer, Sambhal whereby the petitioner and another assistant teacher Smt. Shweta Kaushik were suspended.
Grievance of the petitioner is that suspension of the assistant teacher Smt. Shweta Kaushik has been withdrawn and no action has been taken against her but the petitioner is being kept under suspension and neither enquiry proceedings have been finalized so far nor any opportunity of hearing has been afforded to the petitioner in the enquiry proceedings.
Learned counsel for the respondent Nos.2, 3, 4 and 5 states that enquiry proceedings in the matter of petitioner shall be concluded by the competent authority in accordance with law within a time bound period, and, a final decision shall be taken.
In view of the aforesaid, this writ petition is disposed of directing the respondent No.3 that the disciplinary proceedings initiated against the petitioner, be concluded strictly in accordance with law, expeditiously, preferably within eight weeks from the date of presentation of a certified copy of this order, after affording reasonable opportunity of hearing to the petitioner.
It is made clear that this court has not entered into the merits of the claim of the petitioner.
