Heard learned counsel for the applicants, learned AGA for the State and perused the record.
This anticipatory bail application has been filed by the applicants, namely, Arun Mishra @ Arun Pandey, Sri Krishna Pandey, Bhagav @ Binu Pandey, Poonam Pandey, Manorama Pandey, Mamta Pandey, Niru@Neeraj Pandey, Anand Pandey and Aman @ Muskan in Case Crime No. 0114 of 2020, under sections 498-A, 323, 504, 506 I.P.C. and 3/4 D.P. Act, P.S.- Barhaj, District -Deoria.
Learned AGA points out that against the applicant Nos. 4, 2 and 9, no offence has been found during the course of investigation and the case against them has been made by the Investigating Officer.
As such the application of anticipatory bail against applicant nos. 2, 4 and 9 has become infructuous and the same is accordingly, dismissed being infructuous so far as applicant Nos. 2, 4 and 9.
In support of remaining accused persons it has been pointed out by the learned AGA that after investigation charge sheet has already been filed.
Upon this submission, learned counsel for the applicant has requested that an order for expeditious consideration of the regular bail may be passed.
In view of the request made above, Anticipatory Bail Application against the applicant Nos. 1, 3, 5, 6, 7 and 8 is rejected as not pressed.
A direction is however given to the court below that in case applicant Nos. 1, 3, 5, 6, 7 and 8 surrender and give bail application, the same shall be disposed of expeditiously and preferably on the same day in accordance with law.
