Heard learned counsel for the parties.
The contention advanced on behalf of the revision applicant is that the court below has not properly assessed the income of the applicant and has awarded the maintenance which is too excessive for the applicant.
Matter requires consideration. Admit.
Issue notice to opposite party no. 2 returnable within six weeks.
State may file counter affidavit within aforesaid period. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List immediately thereafter for further orders.
Meanwhile, until further orders, no coercive measures shall be taken against the applicant pursuant to case no.685 of 2014, under Section 125 of Cr.P.C, P.S. Kotwali City, District Bijnor, provided the applicant deposits 50 % arrears from the date of application i.e. 01.12.2014 @ 3000/- per month, till date in three equal bimonthly installments, first falling on 10th April, 2019 onwards alonwith the monthly maintenance for the month of April, 2019 and shall further continue to pay Rs. 3000/- per month as directed, on every 10th day of the month continuously from May, 2019.
However, in case of default by the applicant in complying any of the directions contained herein above, the protection, granted here under this order, shall stand discharged and this criminal revision shall also stand dismissed without reference to the Court.
