Heard learned counsel for the applicant and learned AGA for the State.
By means of this application, the applicant who is involved in case crime no. 370 of 2017, under Sections 396, 412, 120B and 34 IPC, P.S. Gandhi Park, District Aligarh, is seeking enlargement on bail during the trial.
Considering the fact that the complicity of the applicant is clearly established. There is prompt FIR of the incident. It is submitted that the applicant is a B.Tech student. He further submitted that the charge sheet in this case has been submitted by the police. There is recovery of Rs. 65000/- from looted amount. Their is no explanation as to from where this huge cash amount is recovered from the possession of the applicant. In totality of the circumstances the complicity of the applicant is clearly established. I am not inclined to grant any indulgence to the applicant and the applicant is not entitled to be enlarged on bail. The prayer for bail is refused.
Accordingly the application is hereby rejected. The trial court is expected to expedite the trial.
