THE HON'BLE SRI JUSTICE L. NARASIMHA REDDY CIVIL REVISION PETITION No. 3785 OF 2014 ORDER:
The petitioner is the 3rd defendant in O.S No. 267 of 2014 filed by respondent Nos.1 and 2 herein against him and respondent Nos.3 and 4, for the relief of perpetual injunction in respect of the suit schedule property. Respondent Nos.1 and 2 also filed I.A No. 418 of 2014 under Order 39 Rules 1 and 2 CPC. The trial Court passed an order of ad interim injunction on 25-07-2014. The said order is challenged in this C.R.P.
Heard the learned counsel for the petitioner.
Several grounds are urged while challenging the order of ad interim injunction. This Court is not inclined to deal with the same at this stage. The petitioner can file an application to vacate the order of ad interim injunction. Expression of view at this stage would have its own impact upon the further adjudication of the matter.
Therefore, the C.R.P is dismissed leaving it open to the petitioner to file an application to vacate the order of ad interim injunction, if not already filed. As and when such an application is filed, the trial Court shall take up and dispose of the same at the earliest.
The miscellaneous petitions filed in this revision shall also stand disposed of. There shall be no order as to costs.
