Heard Sri Grijesh Tiwari, learned counsel for the petitioner, Sri Madhup Narain Shukla, learned counsel for the caveator, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 08.08.2018 registered as case crime no.0290 of 2018 u/ss. 419, 420, 467, 468, 471, IPC, PS. Mahuli, District Sant Kabir Nagar.
Learned counsel for the petitioner submits that petitioner is working in the institution of respondent no.4 and the FIR has been registered against the petitioner on the ground that the experience certificate which was filed by the petitioner was a forged one. He further submits that the higher authorities have enquired into the matter and the said allegation was found to be false.
Learned counsel for the caveator vehemently opposed the prayer and submitted that two experience certificates were furnished by the petitioner.
Considering the submissions advanced by learned counsel for the parties and the nature of allegations, it is directed that the petitioner shall not be arrested in the above mentioned case till submission of police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
