Heard learned counsel for the petitioner and Shri Sanjay Kumar Singh, learned Standing Counsel.
The petitioner is before this Court for a direction to third respondent to decide application dated 6.11.2018 filed by the petitioner for allotting the licence of fair price shop in question on compassionate ground, which has become vacant after death of the father of the petitioner.
Learned Standing Counsel informs to the Court that so far as the Government Order dated 17.8.2002, which provides for settling the fair price shop on compassionate ground, is concerned, the same has been struck down by this Court in Writ Petition No.16948 of 2018 (Sampurnanand v. State of U.P. & Ors.) decided on 26.10.2018 and as such whatever the claim has been set up by the petitioner, the same is to be seen in the light of the observations made in the aforesaid judgment.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the third respondent to consider and decide the aforesaid application in accordance with law preferably within six weeks from the date of production of certified copy of this order.
