Petitioner appears to have applied for appointment to the post of Panchayat Sahayak/Accountant-cum-Data Entry Operator. It is stated that Government Order, dated 25th July, 2021 is being misconstrued. Taking note of such contention, this Court passed following orders on 5.10.2021:-
"Contention is that petitioner's claim for compassionate appointment is liable to be considered by virtue of Clause 13 of the Government Order, dated 25th July, 2021. It is urged that a candidate belonging to O.B.C. Category can always be considered in the unreserved category as there is no reservation for General Category Candidate. Argument is that respondents have misconstrued the provisions in order to deny consideration to his claim.
Learned Standing Counsel and Sri Pankaj Kumar Gupta for the respondents may obtain instructions.
Post this matter as fresh, once again, on 21.10.2021."
On behalf of respondents, it is urged that as the matter is yet to be decided, the issue can be resolved by the District Magistrate, at the first instance.
In that view of the matter, this writ petition stands disposed of permitting the petitioner to represent his grievance before respondent no. 2, who shall get the facts enquired into and pass necessary orders, in accordance with law, within a period of three months, from the date of presentation of a copy of this order.
