State by HSR Layout Police, Represented by Public Prosecutor, High Court Complex, Bangalore-560001. ..RESPONDENT (By Sri.S.Vishwamurthy, HCGP) This Criminal Petition is filed under Section 439 of Cr.P.C. praying to enlarge the petitioner on bail in Cr.No.768/2016 of HSR Layout Police Station, Bengaluru city for the offence p/u/ss.489(A)(B)(C)(E) r/w Section 34 of IPC.
This Criminal Petition coming on for Orders this day, the Court made the following:
O R D E R Heard the learned counsel for the petitioner and the learned High Court Government Pleader for the respondent- State.
2. This petitioner-Accused No.1 along with the co- accused is chargesheeted in respect of the offence under Sections 489(A)(B)(C)(E) r/w Section 34 of IPC.
3. The allegation is, accused persons were found in possession of counterfeit notes of Rs.2000/- denomination and were attempting to pass on the same to the customers as genuine notes. The second accused is enlarged on bail in Crl.P.No.807/2017 dated 14.3.2017.
4. The investigation is complete and since no criminal antecedent of similar nature is shown to the credit of this petitioner, there is no impediment to allow the petition.
5. Accordingly, petition is allowed. Petitioner is enlarged on bail in Crime No.768/2016 registered by the respondent-police on the following conditions:-
(i) He shall execute a self bond for Rs.5,00,000/- with two local sureties for the likesum to the satisfaction of the concerned Court.
(ii) The sureties shall furnish their Aadhar card and original title deeds pertaining to their immovable properties for the perusal of the concerned Court.
(iii) He shall not leave the session jurisdiction of the Court till the conclusion of the trial.
(iv) He shall not indulge in illegal activities and shall attend the Court regularly on all the hearing dates.
