Heard learned counsel for the petitioners, learned standing counsel for respondent no. 1 and Sri S.K. Verma, learned counsel for respondent nos. 2 to 4.
Learned counsel for the petitioners submits that petitioners are working as Assistant Teachers in Primary School in District Muzaffarnagar and they are being paid lesser salary than their juniors. For redressal of grievance, they have moved collective representation, therefore, a suitable direction may be issued to respondent no. 3 to consider the representation of the petitioners and decide the same within stipulated time.
Sri S.K. Verma, learned counsel for the respondent nos. 2 to 4 submits that petitioners may be directed to file fresh representation before respondent no. 3 and in case any such representation is filed, the same shall be considered and decided at the earliest in accordance with law.
Under such facts and circumstances, this petition is disposed of with liberty to the petitioners to file separate representation before respondent no. 3 within three weeks from today and in case any such representation is filed, respondent no. 3 is directed to consider and decide the same strictly in accordance with law maximum within a period of two months from the date of receiving of representation along with certified copy of the order.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no. 3 to decide the representation of the petitioners after considering the relevant Rule as well as Government Orders occupying the field.
