Order on Criminal Misc. Bail Application Heard learned counsel for the applicant and Sri Rakesh Agrahari learned A. G. A. for the State.
Applicant has moved the present bail application seeking bail in Special Case No.33 of 2005 u/s 147,148,376,149,511,504,506(2) IPC and 3(2) 5 SC/ST Act PS Muskara District Hamirpur.
Looking to the evidence on record and the manner in which crime has been committed and looking to the testimony of the victim and Smt. Dant Kumari eye witness, no case for grant of any indulgence is made out.
Accordingly, the application for bail is rejected at this stage.
However, looking to the facts and circumstances of the case the hearing of the appeal is expedited under Chapter-VIII Rule 33A of the Rules of Court.
Let the paper book be prepared within two months from today and thereafter appeal be listed for hearing before appropriate Bench.
