Issue notice to respondent no. 3.
Learned counsel for the appellant states that hearing /disposal of the present special appeal is dependent upon the reference made to the larger Bench in the case reported in 2013 ( 5) ADJ 755 Jahaj Pal Vs. D.I.O.S. and another ).
Connect and list this Special Appeal along with Special Appeal no. 35 of 2014.
In the mean time, the interim order which held the field during the pendency of the writ petition, shall continue to remain operative till the next date of list.
