The applicant is before this Court against the wilful defiance of the order dated 11.2.2019 passed in Writ Petition No.2106 of 2019 (Arun Kumar Misra v. Commissioner/ Registrar Cooperative Societies U.P. & Anr.) by which the respondent was directed to decide the representation of the applicant regarding arrears of salary and retiral dues.
The Court has proceeded to examine the record in question. From the order dated 18.3.2019, which is annexed as Annexure No.5 to the contempt application, this much is reflected that the department has accepted the claim of the applicant to the tune of Rs.1,75,026/- towards provident fund; Rs.2,89,280/- towards gratuity; Rs.43392/- towards leave encashment and Rs.203656/- towards interest on the arrears of salary. The order shows that Rs.1,75,026/- towards provident fund has been released and remaining Rs.5,36,328/- will be released in two installments in September 2019 and March 2020.
Considering the facts and circumstances of the case, the contempt application stands disposed of asking the authority concerned to comply with the writ Court order in question in letter and spirit and the amount in question be paid to the applicant preferably within six weeks as per the aforesaid assurance. Notices, if any, stand discharged.
