The grievance of the petitioner was with regard to the stipulation of minimum two years of remaining service for eligibility to be included in the zone of consideration for promotion in the service of the United India Insurance Company. By order dated 11.09.2012, this Court directed the respondents to consider the case of the petitioner also in the pre-promotional exercise of 2012-13 for promotion to the post of Officer, Scale-VII. WV MP No.3333 of 2012 was filed by the United India Insurance Company Limited to vacate the said order.
2. It is stated by Sri Vedula Srinivas, learned standing counsel appearing for the United India Insurance Company, that the case of the petitioner was considered pursuant to the interim order but he was not found fit for promotion. It is further stated that the petitioner has also retired from service.
3. As the case of the petitioner was considered pursuant to the interim order but was not granted promotion and as he has also been superannuated, the issue raised in the writ petition becomes purely academic and does not survive for adjudication on merits.
4. The writ petition is accordingly closed. The interim order dated 11.09.2012 has worked itself out. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
