Shri Vinod Kumar Rai, learned counsel for the petitioner submitted that the petitioner, who is a qualified teacher for teaching Physical Education subject for the Class XIth and XIIth, has been directed with the impugned order dated 1.4.2019, passed by respondent no.5, to teach Physical Education subject to the lower class (i.e. Class IXth and Xth).
It is further submitted by learned counsel that unqualified teacher has been allowed to teach Physical Education subject to class XIth and XIIth and in this regard, the petitioner has made a representation dated 2.4.2019 to the Committee of Management, M.M.H.V. Inter College, Ghaziabad (respondent no.5).
The issue which has been raised by learned counsel for the petitioner cannot be decided under the powers of matter under Article 226 of the Constitution of India.
No prejudice is caused to the petitioner. Therefore, the prayer made in this petition, is hereby, rejected.
However, it is directed that respondent no.5 (Committee of Management, M.M.H.V. Inter College, Ghaziabad) may decide the representation dated 2.4.2019, in accordance with law.
With the aforesaid directions, the writ petition stands disposed of.
