Heard learned counsel for applicant(s), learned A.G.A. and perused the record.
This bail application has been preferred by the accused- applicant(s), Arun Kumar @ Brijesh Kumar, who is involved in Case Crime No. 23 of 2020, under Sections 419, 420 I.P.C. and 66D I.T Act, 2008, P.S.- Cyber Crime, District- Moradabad .
Learned counsel for the applicant(s) in support of his prayer for bail submits that the applicant(s) is innocent and he has been falsely implicated in the present case. It is further submitted that the alleged account number is not of the applicant same has been opened by co-accused Rajkumar in the name of the applicant and the applicant has no concern and is not involved in the alleged offence.
Learned A.G.A opposed the contentions made by the learned counsel for the applicant and contended that amount of Rs. 1,75,000/- was transferred in the account of applicant Arun Kumar @ Brijesh Kumar.
Admittedly, the account in which the said amount is transferred is of the applicant and same has been verified by the concerned bank.
In view of the facts and circumstances of the case and the submissions made by learned counsel for both sides and going through the record, without commenting on the merits of the case, I do not find it a fit case for bail.
Accordingly, bail application is rejected.
