Heard learned counsel for the applicant; Shri Dhiraj Kumar Pandey, learned counsel for the informant and learned A.G.A. for the State.
The instant anticipatory bail application has been filed with a prayer to grant anticipatory bail to the applicant, Arun Kadara, in Case Crime No. 4 of 2021, under Sections- 498-A,323,328 I.P.C., and section 3/4 of Dowry Prohibition Act, Police Station- Kotwali Nagar, District- Saharanpur.
Despite time granted no counter affidavit has been filed.
Applicant has been falsely implicated in this case on account of matrimonial dispute.Learned counsel for the applicant has submitted that marriage of the applicant with victim took place on 16.4.2019.He has been falsely in this case on account of matrimonial dispute.
The applicant has already been enlarged on interim anticipatory bail by this Court by order dated 10.02.2021.
The order is confirmed.
Applicant will remain on anticipatory bail till cognizance is taken by the court on the police report u/s 173 (2) Cr.P.C. on same terms and conditions as mentioned in the order dated 10.02.2021.
The anticipatory bail application is allowed to the aforementioned extent.
