JUDGMENT / ORDER

Petitioners are accused Nos.1 and 2 in Crime No.777 of 2014 of the Cherthala Police Station for the offences punishable under Secs.323, 324 and 306 r/w Sec.34 of the Indian Penal Code, apprehend arrest and have filed this application.
2. Learned Public Prosecutor has opposed the application.
It is submitted that on 06.04.2014 at about 6.30p.m, the petitioners assaulted the de facto complainant with deadly weapons causing fractures.
3. Learned counsel submits that the allegations are not true. The de facto complainant who was in a drunken mood teased a lady which was resisted by the local people. Petitioners are not involved in the incident.
4. I have gone through the CD file and find prima facie materials against the petitioners. The wound certificate shows that the de facto complainant suffered serious injuries. Statement of the Medical Officer who attended the de facto complainant refers to the injury suffered by the de facto complainant on his left eye.

5. True that according to the learned counsel, the petitioners are also sustained injuries. But, that is no ground to grant them pre-arrest bail as that would affect the investigation.
The application is dismissed. It is directed that in case the petitioners are arrested, they shall be produced before the jurisdictional magistrate as early as possible.
