When the matter came up for hearing on 05.01.2017, there was no representation on behalf of the appellant and hence, it was directed to be posted today under the caption ?For dismissal?. Today, at about 11.00 a.m., when the matter was taken up for hearing, there was no representation for both sides. However, it was passed over and at about 11.30 a.m., when the matter was taken up for hearing, again there was no representation for both sides. In such circumstances, this Court has no other option except to dismiss the second appeal for non-prosecution.
2. Accordingly, the second appeal is dismissed for non-prosecution. No costs.
