Supplementary affidavit filed by the applicant today, is taken on record.
Heard learned counsel for the applicant, learned AGA for the State and perused the record.
Applicant Arti Mishra is named in the FIR, though the co-accused persons Arti Mishra and Smt. Renu Mishra, were attributed the role of pouring kerosene oil and setting the victim Smt. Prem Lata Mishra ablaze. The deceased sustained 80% burn injuries. There is dying declaration of Smt. Prem Lata Mishra, which is annexed as annexure SA-5 to the affidavit accompanied with the bail application, wherein the victim herself has attributed the role of pouring Kerosene oil and setting her ablaze on both the accused.
Learned AGA has drawn attention of the Court towards the statements of eye witness account given by Munib Tiwari and Deena Nath Dubey, who very unambiguously narrated the involvement of the accused persons in the commission of the crime.
Keeping in view the severity of the offence, evidence, complicity of the accused, without expressing any opinion on merits, this Court declines to grant any relief to the accused applicant.
The application for bail is, accordingly, rejected.
However, the trial court is expected to gear up the trial of the aforesaid case and conclude the same by 31.12.2018 in accordance with law, without granting any unnecessary adjournment to either of the parties, provides the applicant fully cooperates in conclusion of the trial.
Office is directed to transmit a certified copy of this order to the court concerned within a fortnight.
