Heard learned counsel for the applicants and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the court below to decide the Criminal Case No. 66 of 2015 (Arti Devi and another Vs. Devendra Kumar), under Section 125 Cr.P.C., pending before the court of Principal Judge, Family Court, Jaunpur within stipulated period.
It is come on record that vide order dated 11.08.2016, interim maintenance allowance @ Rs. 2,500/- per month to the applicant no. 1 and @ Rs. 1,000/- per month to the applicant no. 2 (her daughter) has been awarded by the learned Court below.
According to the applicants neither any amount has been paid to them under the interim maintenance allowance nor the application under Section 125 Cr.P.C. has been finalized till date.
Leaving it open to the applicants to seek recovery of the amounts awarded under the interim maintenance allowance, the present application is disposed of with a direction to the court below to decide the aforesaid case in accordance with law, without granting any unnecessary or long adjournments to either of the parties as expeditiously as possible, if there is no other legal impediment.
