Arshad vs State

High Court Of Gujarat|19 June, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the convict through his wife praying for temporary bail for a period of 60 days on the ground that the applicant-wife of the convict is having pregnancy of two months, she is also having lump in the left breast, she is not keeping good health and her aged mother-in-law also requires care to be taken. It is also mentioned that she has two children, for whom there is no male member in the family who can take care.
Learned APP Mr.Pujari invited attention of the Court to the jail remarks. Only recently i.e. in the month April-May, the convict was out to attend marriage of his sister. His two co-convicts are at present on temporary bail and are to report on 16.07.2012 and 19.07.2012. In these circumstances, the Court finds no reason to enlarge the convict on temporary bail. The application is rejected.
However, the convict may file a fresh application after 19.07.2012-the date on which other co-convict is to report.
