Heard learned counsel for the applicants, Sri Vikas Sahai,the learned A.G.A. for the State and perused the record.
The instant bail application has been moved seeking anticipatory bail in light of the apprehension of the arrest of the applicants in Case Crime No. 0612 of 2019, under Sections 420, 328, 376-D and 506 I.P.C., Police Station Tronica City, District- Ghaziabad.
The Court finds itself unable to countenance the prayer for grant of anticipatory bail bearing in mind the statement of the victim as recorded under Section 164 Cr.P.C. Although, learned counsel refers to some inconsistencies with respect to the place where the alleged crime is stated to have been committed, that does not impress the Court bearing in mind the fact that the allegation of rape has remained unaltered right through.
In view of the aforesaid fact, the prayer for interim anticipatory bail is refused.
The Application is consequently rejected.
