Heard learned counsel for the petitioner and Sri Utkarsh Tripathi, Brief Holder for the State respondents. Sri Manu Singh, Advocate has put in appearance on behalf of respondent no.4.
According to the learned counsel for the petitioner Civil Suit is already pending before the Civil Court, instituted by the father of the petitioner, in which petitioner has since been substituted. In case petitioner wants injunction against private respondents, appropriate remedy would be to press the application for interim injunction before the Civil Court and/or to avail such other remedy as may be available, with respect to the proceedings before the Civil Court and not by way of petition under Article 226 of the Constitution for grant of injunction during the pendency of the suit.
Petition is accordingly dismissed.
