Heard Sri Yogendra Pal Singh, learned counsel for the applicants, learned A.G.A. for the State and perused the record.
This bail application under Section 439 Cr.P.C. has been moved by the accused-applicants Arshad and Intzar @ Bhusan, who are involved in Case Crime No. 527 of 2017, under Section 3/5/8 of Cow Slaughter Act and Section 429 IPC, Police Station - Jani, District - Meerut.
As per prosecution version, on 23.10.2017 at about 03.00 A.M., one quintal 'gaumans' (beef) was recovered from the joint possession of co-accused Mohd. Shehnawaz Qureshi and Mohd. Shahalam Qureshi. The applicant and other co-accused fled away from the spot.
Learned counsel for the applicants contended that the applicants have been falsely implicated in this case. No offence, whatsoever is made out against them. Absolutely baseless and concocted allegations have been levelled against the applicants, who are innocent. Moreover, there is no public witness of the alleged recovery. Applicant - Arshad has a criminal history of four cases, arising out of Case Crime Nos. 374 of 2016, 14 of 2018, 15 of 2018 and 18 of 2018, in all of which he is bailed out. Applicant- Intzar @ Bhusan also has a criminal history of four cases, arising out of Case Crime Nos. 374 of 2016, 266 of 2017, 14 of 2018 and 15 of 2018, in all of which he is bailed out.
Per contra, learned A.G.A. has opposed the prayer for bail.
Without commenting on the merits of the case, considering the facts and circumstances of the case, I find it a fit case for enlarging the applicants on bail.
Let the applicants - Arshad and Intzar @ Bhusan be released on bail in the aforesaid case crime number on their furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned.
Accordingly, the instant bail applications are allowed. Order Date :- 27.3.2018 I. Batabyal
