Nandakumar, Advocate) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India, praying to quash the impugned order dated 23.11.2018 passed by the XXXVIII Additional City Civil and Sessions Judge, Bengaluru sitting in Court Hall No.39 in City Civil Court, Bengaluru, in I.A.No.01/2018 in AA No.439/2018 at Annexure – A and etc., This Petition coming on for Orders, this day, the Court made the following:-
ORDER Ms. Alka Tripathi, learned counsel for Sri. Ajay J. Nandalike, learned counsel for the petitioner.
Ms. Gawry Cootaiah, learned counsel for Sri. C.K. Nandakumar, learned counsel for the respondent.
Learned counsel for the respondent submits that in this petition, petitioner has challenged the interim order passed in the proceeding under Section 9 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as ‘the Act’ for short).
2. It is further submitted that proceeding under Section 9 of the Act has been withdrawn. Therefore, nothing survives for adjudication in this writ petition.
3. The aforesaid statement is taken on record.
Accordingly, writ petition is dismissed as having become infructuous.
