Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record.
The instant application has been filed seeking quashing of summoning order dated 7.4.2021 passed by the Civil Judge (Senior Division) / J. M., Tilhar, Shahjahanpur in Complaint Case No. 817 of 2020; Smt. Varsha Versus Arpit Agarwal, under Sections-498A, 323, 506 IPC and Sections- 3/4 of D. P. Act, P. S.-Tilhar, Shahjahanpur.
A prayer has been made that the matter between the parties is purely matrimonial one and there are chances of amicable settlement between the parties. Applicant's counsel strenuously urged that this case may be referred to the Mediation and Reconciliation Centre, District- Shahjahanpur, so that the litigants may have a chance to settle their dispute on their own terms through mediation. It is also argued that all the male/female members belonging to the same family have been nominated in the complaint.
Accordingly, the matter is being referred to the Mediation and Reconciliation Centre, District-Shahjahanpur. The applicant no.1 will deposit Rs. 10,000/- within two weeks from today at the Mediation Centre, Shahjahanpur. Out of the same Rs.8,000/- will be paid to Opposite Party No. 2 for subsistence and to meet out the expenses.
It is further directed that the Mediation Centre shall conclude the mediation and conciliation proceedings as expeditiously as possible preferably within a period of two months after giving notices to both the parties.
In the event the mediation is failed, the court below shall be at liberty to initiate proceedings against the applicants in accordance with law.
For a period of fifteen days from today, no coercive action shall be taken against the applicants in the aforementioned case.
In view of above, the application under Section 482 Cr.P.C. is finally disposed of.
