Supplementary affidavit filed today is taken on record.
The present criminal revision has been filed against the order dated 8.6.2016 passed under Section 125 Cr.P.C., by which the applicant has been awarded monthly maintenance allowance @ Rs. 60,000/- from the date of the order. It has been stated that the parties have entered into a compromise. In that regard, it has been stated in paragraph 5 of the supplementary affidavit filed today by applicant no.1:-
"That all the financial and other matrimonial issues have been settle in between the parties. Therefore, revisionist no.1 do not want any further legal proceeding or maintenance awarded by the Court below under Section 125 Cr.P.C. in Case No. 545 of 2015 (Arpita Mishra Vs. Anoop Kumar Tiwari,), District Kanpur Nagar."
She further pleaded that she has no objection to the present application being allowed in entirety. Parties are present in Court today. Applicant no.2 states that a divorce proceedings instituted by him is still pending. He further states that now the applicants will apply to the Court below to treat the pending proceedings as are for grant of decree of divorce with mutual consent. Applicant no.1 does not object to the statement made by the applicant no.2 that the parties have aggrieved to dissolve their marriage through a decree of divorce with consent.
In that view of the matter. the present revision application is allowed. The order dated 8.6.2016 passed by Additional Principal Judge Family Court, Kanpur Nagar, is set aside.
