This Writ Petition is filed for a certiorari to call for records in CCS Proceeding No.E2/420/2014 (earlier numbered as E2/240/2014) and to quash Order, dated 13-10-2014, passed therein by respondent No.2.
I have heard Mr.C.B.Ram Mohan Reddy, learned Counsel for the petitioner, learned Government Pleader for Civil Supplies (TG) appearing for respondent Nos.1 to 3 and Mr.V.Venkataramana, learned Senior Counsel appearing for respondent No.4.
The petitioners, who claim to be the owners of small plots of different extents situated at Bowrampet Village, Qutbullapur Mandal, Ranga Reddy District, filed this Writ Petition feeling aggrieved by grant of interim order of suspension by respondent No.2- Commissioner, pending appeal filed by respondent No.4 against Order, dated 02- 04-2014, passed by respondent No.3- Collector, refusing to issue B-form license in his favour.
Inasmuch as the appeal is pending before respondent No.2, who has exercised his discretion by granting an interim order pending appeal, I find it inappropriate to interfere with the said interim order at this stage. However, respondent No.2 is directed to dispose of the appeal itself after hearing both the parties within two months from the date of receipt of this order. It is, however, made clear that disposal of this Writ Petition shall not be construed that this Court has endorsed the order impugned in this Writ Petition on merits and the impugned order shall not weigh with respondent No.2, in any manner, while disposing of the appeal.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel, WPMP.No.39995 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
