By this application, the applicant seeks permission to amend the cause title of Second Appeal No.93 of 2005 as well as Civil Application No.10130 of 2011, by substituting the names and addresses of the respondents with the names and addresses as described in paragraph 2 of the memorandum of application.
Heard Ms. Nidhi Japee, learned advocate for the applicant and Mr. Premal Joshi, learned advocate for the respondents.
Having regard to the averments made in the application, the application is allowed. The applicant is permitted to substitute the names and addresses of the persons more particularly described in paragraph 2 of the memorandum of application in place of the respondents No.1 and 2 herein, and to amend the cause title of Second Appeal No.93 of 2005 as well as Civil Application No.10130 of 2011 accordingly.
The application stands disposed of accordingly.
