On 8.3.2007, this Court passed an interim order staying the further proceedings of Complaint Case No. 608 of 2006 (Shanti Vs. Arjun and others) under Sections 323, 342, 498-A, 504 IPC and Section 3/4 D.P. Act, Police Station Persomalin, District Maharajganj till the next date of listing in respect of applicant Nos. 2 to 4.
On 28.3.2018, the Apex Court in the case of Asian Resurfacing of Road Agency Pvt. Ltd and others vs. Central Bureau of Investigation; AIR 2018 SC 2039 has directed that in all pending cases where stay against proceedings of a civil or criminal trial is operating, the same will come to an end on expiry of six months from today unless in an exceptional case by a speaking order such stay is extended. In the present case, the interim order was not extended and it stands vacated.
In view of above, the present application u/s 482 Cr.P.C. is dismissed for the want of prosecution.
