JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the convict through jail seeking temporary bail for a period of 30 days so as to arrange for rental premises for his family and also to arrange for the admission of his child.
Rule.
Learned APP, Mr.Pujari, waives service of rule on behalf of respondent-State.
Learned APP invited attention of the Corut to the jail remarks.
The convict is undergoing life imprisonment for offence under Section 302 of Indian Penal Code and 135 of Bombay Police Act in Sessions Case No.63 of 2000; wherein, he was convicted by judgment and order dated 8.1.2008.
By now, he has undergone 4 years, 8 months and 23 days as on 28.5.2012. The convict has enjoyed temporary bail on one occasion and furlough leave on 2 different occasions and every time, he reported in time. Last one, he was out in the month of November, 2011 on 2nd furlough.
For the contents of the application, the application is allowed. The convict is ordered to be released on temporary bail for a period of 30 days from the date of his release on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the Jail authorities.
The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute.
