Heard learned counsel for the applicant, Sri K.K. Rao for the informant/complainant, Sri Radhey Shyam Maurya, the learned A.G.A. for the State and perused the record.
The present bail application has been filed by the applicant in Case Crime No. 165 of 2019, under Sections 302 I.P.C., Police Station Nebuwa Naurangiya, District- Kushi Nagar with the prayer to enlarge him on bail.
For the purposes of evaluating the prayer for bail, the Court notes the allegation which is levelled and which is to the effect that the deceased was having an affair with the sister of the applicant and incensed with that he was called out by the accused including the applicant, assaulted, beaten up and thereafter set aflame. The deceased miraculously escaped from the scene and upon reaching his residence narrated the entire incident before his relatives and other villagers. This is evident from the statement of Vakil Gupta, Lal Sahab and Virendra Gupta. The case diary also refers to the entire episode having been captured on a mobile phone. The deceased was thereafter taken for treatment to Gorakhpur where he breathed his last on 10 June 2019.
Bearing in mind the seriousness of the allegations which are levelled which clearly fall within the genre of honour killing, the Court finds no ground to enlarge the applicant on bail.
The Bail Application is dismissed.
